This website is operated by WRTEKNICA. Throughout the site, the terms “we”, “us” and “our” refer to WRTEKNICA. By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following Terms & Conditions (“Terms”). These Terms apply to all users of the site, including browsers, customers, merchants, and contributors of content.
Our e-commerce platform is provided by WooCommerce, which enables us to sell our products and services online.
Motorsports Warning & Assumption of Risk
MOTORSPORTS ARE INHERENTLY DANGEROUS.
Racing, high-performance driving, and related activities involve significant risk of injury or death.
Products sold by WRTEKNICA are intended for closed-course competition/off-road use only and must never be used on public roads or highways.
By purchasing, installing, or using our products, you acknowledge and agree that:
– You assume all risks arising out of motorsports activities and vehicle modification.
– WRTEKNICA is not responsible for any injury, death, property damage, or other losses.
– WRTEKNICA disclaims all liability for indirect, incidental, or consequential damages, including loss of profits, loss of use, or data.
– It is the customer’s sole responsibility to ensure that their vehicle remains safe for operation following any modifications or installations.
Competition Use & Emissions
Unless explicitly stated otherwise, all products are intended for competition/off-road use only.
They may be illegal for use on public roads, may cause your vehicle to fail emissions testing, and may void manufacturer warranties.
Compliance with federal, state, and local laws (including California Air Resources Board regulations) is solely the customer’s responsibility.
Professional Installation
Professional installation is strongly recommended.
Vehicle modifications can alter handling, drivability, safety, and durability.
After installation, all torque specifications must be verified and re-checked after initial use.
Customers are solely responsible for operating their vehicles safely after modifications.
Products & Warranties
All products are sold “AS IS.”
WRTEKNICA provides no warranties of any kind, express or implied, including merchantability or fitness for a particular purpose.
Any manufacturer warranties (if applicable) are provided solely by the manufacturer and must be pursued directly with them.
WRTEKNICA makes no representation that products are legal for use on public roads, emissions-compliant, or will not affect OEM warranties.
Returns & Refunds
All sales are final. WRTEKNICA generally does not accept returns or exchanges.
Exceptions may be made at our sole discretion if required by law or in cases of incorrect or defective items.
In such cases:
- Items must be new, uninstalled, and in original packaging.
- Authorization (RMA) is required before returning.
- Shipping costs are non-refundable, and the customer is responsible for return shipping.
- Products that have been installed, used, custom-ordered, or otherwise altered are strictly non-returnable.
By purchasing from WRTEKNICA, you agree that you will not attempt to return products except as explicitly permitted under this policy.
Initiating or filing a credit card chargeback on a valid and fulfilled order constitutes a breach of these Terms and may result in recovery of costs.
Shipping Policy
We reserve the right to make changes to these Terms at any time, and such changes will be effective immediately upon being posted on the Site. Each time you use the Site, you should review the current Terms. You can determine when these Terms were last revised by referring to the “LAST UPDATED” legend at the top of these Terms of Use. Your continued use of the Site will constitute your acceptance of the current Terms; however, any material change to these Terms after your last usage of the Site will not be applied retroactively. Except for such material changes, the Terms that were in effect at the time any claim or dispute arose between you and WRTeknica will be applied.
Your Account
Customer pays all shipping charges.
Shipping costs are calculated at checkout and are non-refundable.
Oversized items (e.g., racing seats, roll bars, harness bars, exhaust systems, cages) may require freight delivery and additional charges.
Orders typically ship on business days; shipping times are estimates only.
Expedited shipping is not guaranteed. If a carrier delay occurs, WRTEKNICA is not liable for damages beyond refunding the expedite premium (if applicable).
Title and risk of loss pass to the customer when the package is accepted by the carrier.
WRTEKNICA is not responsible for lost, stolen, or misdelivered packages after confirmed delivery by the carrier.
International orders: all duties, taxes, brokerage fees, and import costs are the customer’s sole responsibility.
Orders refused due to unpaid import charges will not be refunded.
Order Acceptance & Fraud Prevention
We reserve the right to refuse, cancel, or limit any order at our discretion, including suspected fraud, pricing errors, or restricted destinations.
We may require additional verification before accepting or shipping an order.
Personal Information & Privacy
Your submission of personal information through the site is governed by our Privacy Policy.
Payment processing is handled by third-party processors. WRTEKNICA does not store payment card data.
All transactions are encrypted and transmitted securely.
Disclaimer of Warranties; Limitation of Liability
The Service and all products are provided “as is” and “as available.”
WRTEKNICA, its affiliates, officers, employees, contractors, and suppliers shall not be liable for any damages, including direct, indirect, incidental, punitive, special, or consequential damages, arising out of your use of products or the Service.
WRTEKNICA shall not be liable for delays or failures to perform resulting from causes beyond its reasonable control, including natural disasters, labor disputes, material shortages, or transportation disruptions.
Indemnification
You agree to indemnify and hold harmless WRTEKNICA, its affiliates, officers, and employees from any claims, damages, or expenses (including attorneys’ fees) arising out of your breach of these Terms, your use of products, or your violation of law.
This indemnification includes claims alleging negligence by WRTEKNICA.
Governing Law; Venue
These Terms shall be governed by the laws of the State of California.
Venue for any disputes shall lie exclusively in the state or federal courts of San Bernardino County, California.
Dispute Resolution; Arbitration
To the maximum extent permitted by law, you agree that:
- Any dispute with WRTEKNICA shall be resolved through binding arbitration administered by the American Arbitration Association.
- You waive any right to a jury trial.
- You waive any right to participate in a class action lawsuit or class-wide arbitration against WRTEKNICA.
- Individual arbitration is your sole remedy.
The arbitration shall take place in San Bernardino County, California. Each party shall bear its own arbitration costs and fees unless otherwise required by law.
Severability
If any part of these Terms is held unlawful, void, or unenforceable, the remaining provisions remain in effect.
Termination
These Terms remain effective until terminated by either party.
If you fail to comply, WRTEKNICA may suspend or terminate your access immediately, without notice, and you will remain liable for all amounts due.
Entire Agreement
These Terms, together with any posted policies (e.g., Shipping, Returns, Privacy), constitute the entire agreement between you and WRTEKNICA and supersede all prior agreements.
